Terms of service

§1 General provisions
The provider of the stacjajaponia.pl service (hereinafter “Stacja Japonia”) is EUNIKA PREMIUM sp. z o.o., with its registered office in Mikołów (43-190), ul. Karola Miarki 10/2, Poland, entered in the Register of Entrepreneurs of the Polish National Court Register (KRS) under no. 0000830705, NIP 6351853636, REGON 385627717, share capital PLN 5,000, represented by its management board (Katarzyna Wałoszek — President of the Board).

These Terms set out the rules for using Stacja Japonia’s services and for concluding and performing service agreements.
§2 Nature of the service
Stacja Japonia provides ADVISORY and ORGANISATIONAL services (trip planning and organisation). Stacja Japonia is NOT a travel agency or a tour operator within the meaning of the Polish Package Travel Act — it does not sell package tours and does not conclude transport, accommodation or other travel contracts in its own name.
The fee charged by Stacja Japonia is remuneration for the provider’s work (advice, planning, organisation). The costs of the trip itself (flights, trains, accommodation, admission tickets, etc.) are borne by the Client directly, with the respective providers.
§3 Scope of services and packages
The scope of work depends on the chosen package — “Travel Map” (a trip plan), “Ready for Adventure” (plan + booking assistance) and “With Paweł on the Ground” (full support). The detailed scope of each package is described at /pakiety.php and forms part of the agreement.
Package prices cover trips of up to 14 days and groups of up to 8 people. A longer trip or a larger group is quoted individually.
§4 Conclusion of the agreement
Contact via the form, e-mail or WhatsApp is an enquiry and is free and non-binding. The agreement is concluded when the Client and the provider agree on the scope and price of the service, and the Client confirms the order and accepts these Terms.
§5 Prices and payments
The prices shown on the website are prices for the provider’s service. Prices in foreign currencies are indicative (converted at the National Bank of Poland rate) — the binding amount is the one agreed in the contract. The method and timing of payment (e.g. a deposit and the remainder) are agreed when the contract is concluded.
§6 Delivery and revisions
The service is delivered within the time agreed with the Client, allowing for the time needed to prepare the plan properly. The number of consultations and revision rounds follows from the chosen package. Materials (the plan, travel documents) are delivered electronically.
§7 Right of withdrawal (consumers)
A consumer has the right to withdraw from a distance contract within 14 days without giving a reason. However, if the Client requests that the service begin before that period expires and consents to this, the right of withdrawal is lost once the service has been fully performed; if withdrawal occurs during performance, the Client must pay for the services rendered up to the moment of withdrawal (Articles 35 and 38 of the Polish Consumer Rights Act).
§8 Complaints
Complaints may be submitted to wyjazdy@otwarcinaswiat.pl. A complaint should describe the objections. The provider will consider the complaint within 14 days of receipt and inform the Client of the outcome.
§9 Liability
Stacja Japonia provides its advisory service with due care, but does not guarantee the availability or prices of third-party services (airlines, hotels, carriers). The Client is responsible for bookings, travel documents (passport, visa), insurance and compliance with entry requirements. The provider is not liable for events beyond its control (force majeure, carrier decisions, weather conditions, etc.).
§10 Personal data
The rules for processing personal data are described in the Privacy Policy.
§11 Final provisions
Matters not covered here are governed by Polish law. The provider may amend these Terms for important reasons; agreements concluded before an amendment are governed by the Terms in force on the date the agreement was concluded. A consumer may use out-of-court complaint procedures, including the EU ODR platform (ec.europa.eu/consumers/odr).
